Toy Guaranty
Arrowhead Aviaries (hereby referred to as AA) guarantees to the original purchaser for a period of one year from the date of delivery that each toy sold by AA is free from defect in materials and workmanship. AA also guarantees to the original purchaser for a period of one year from the date of delivery to perform a one time repair or replacement of any AA toy that has been damaged or destroyed by a parrot species for which, the toy was recommended. The purchaser must return the toy directly to AA along with their original dated receipt of purchase (a copy is acceptable) and is responsible for any shipping costs or transportation connected with repair or replacement covered by the guarantee. Unauthorized alteration or repair, damage resulting from misuse, neglect, or other factors beyond the control of AA are the sole responsibility of the purchaser.
AA reserves the right to make changes in the prices and/or designs of its products without any obligation to include these changes in any products previously manufactured. One time correction by repair or replacement of toy damage caused by a parrot species for which the toy was recommended shall constitute fulfillment of all guarantee obligations on the part of AA.
This Guarantee is in lieu of all other guarantees, express or implied, including guarantee of merchant ability to fitness for a particular purpose, and is the sole and exclusive remedy for any claim of damage arising from any defect in or damage to a AA toy.
AA shall have no liability for consequential damages or personal or parrot injury, or for loss, damage, or expense directly or indirectly arising from the use of its products. No agent, distributor, or other party is authorized to make any other guarantee on behalf of AA or to assume for AA any other liability with respect to its products. Other products that may be marketed by AA but are not manufactured by AA are not covered under this agreement.
